Please read these terms carefully before using our website, home services, or PetDay Care Planner.

These Terms of Service ("Terms") govern your use of the website operated by IOTERA SMART LLC ("Company," "we," "us," or "our"), the home services we provide, and our mobile application PetDay Care Planner (package com.petday.care). By accessing our website, requesting our services, or using the App, you agree to be bound by these Terms.

1. Home Services

IOTERA SMART LLC provides local home and repair services within our designated service area in and around Littleton, Colorado, including HVAC repair, plumbing, cleaning, and moving assistance. Specific services, availability, and pricing are subject to assessment at the time of your request. Quotes provided online or by email are estimates and may change after an on-site evaluation.

2. PetDay Care Planner

PetDay Care Planner is a personal scheduling tool for household pet care routines (such as feed, walk, groom, clean, and train tasks). In V1.0 the App is offline-first, does not require an account, and stores data locally on your device.

  • The App is a scheduling helper only. It does not provide veterinary advice, diagnoses, prescriptions, dosage guidance, or medical care.
  • Walk tasks are time-based reminders only and do not include GPS tracking or route recording.
  • You are responsible for the accuracy of information you enter and for following professional veterinary guidance for your pets’ health needs.
  • V1.0 has no ads and no in-app purchases. Features may change in future versions; material changes to data practices will be reflected in our Privacy Policy.

3. Eligibility

By using our website, services, or App, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal authority to enter into these Terms. If you request home services on behalf of a property owner or business, you represent that you have authorization to do so.

4. Appointments and Scheduling (Home Services)

  • Appointments are subject to technician availability and weather or safety conditions.
  • We will make reasonable efforts to arrive within the scheduled window and will notify you of significant delays when possible.
  • Cancellation or rescheduling should be communicated as early as possible. Repeated no-shows or last-minute cancellations may result in a cancellation fee.

5. Pricing and Payment (Home Services)

  • Prices are quoted in U.S. dollars and may include labor, materials, and applicable taxes unless otherwise stated.
  • Additional work discovered during service may require your approval before proceeding.
  • Payment is due upon completion of service unless other arrangements are agreed upon in writing.
  • We accept payment methods as communicated at the time of service. Returned checks or failed payments may incur additional fees.

6. Customer Responsibilities (Home Services)

You agree to:

  • Provide accurate contact and service address information
  • Ensure safe access to the work area for our technicians
  • Disclose known hazards, structural issues, or prior repair history relevant to the job
  • Secure pets and valuables before our arrival
  • Be present or designate an authorized adult on-site when required

7. App Use and Local Data

  • You are responsible for maintaining access to your device and for backing up any data you wish to keep (for example, via CSV export).
  • Clearing app data or uninstalling the App may permanently remove local content.
  • You agree not to misuse the App, attempt to reverse engineer it except where permitted by law, or use it for unlawful purposes.

8. Warranties and Guarantees (Home Services)

We stand behind the quality of our workmanship. Specific warranty terms for parts and labor will be provided at the time of service completion when applicable. Warranties do not cover damage caused by misuse, unauthorized modifications, natural disasters, or issues unrelated to the original repair.

9. Disclaimer (App)

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE APP DOES NOT REPLACE PROFESSIONAL VETERINARY CARE.

10. Limitation of Liability

To the fullest extent permitted by law, IOTERA SMART LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, home services, or App. Our total liability for any claim related to a specific home service shall not exceed the amount paid for that service. For App-related claims, our total liability shall not exceed USD $50, except where prohibited by law.

We are not responsible for pre-existing conditions, hidden defects, or issues that could not reasonably be detected during a standard inspection, nor for health outcomes related to pet care decisions you make using the App as a scheduling aid.

11. Website Use

You agree not to:

  • Use our website for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or data
  • Submit false or misleading information through our forms
  • Reproduce, scrape, or distribute website content without our written permission

12. Intellectual Property

All content on this website and in the App — including text, logos, images, design, and software — is the property of IOTERA SMART LLC or its licensors and is protected by applicable copyright and trademark laws.

13. Privacy

Our collection and use of information is described in our Privacy Policy, which includes specific practices for PetDay Care Planner V1.0.

14. Dispute Resolution

Any dispute arising from these Terms, our services, or the App shall first be addressed through good-faith negotiation. If unresolved, disputes shall be governed by the laws of the State of Colorado, and any legal proceedings shall be brought in the courts of Jefferson County, Colorado, or the applicable federal courts in Colorado, unless applicable law requires otherwise.

15. Indemnification

You agree to indemnify and hold harmless IOTERA SMART LLC, its owners, employees, and contractors from any claims, damages, or expenses arising from your breach of these Terms, misuse of our services or App, or inaccurate information you provide.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of our website, services, or App after changes constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
